New regulations now apply in Wales, and the 2010 Regulations are no longer in force

The new Child Minding and Day Care (Disqualification) (No. 2) (Wales) Regulations 2022 have come into force 06.12.22.

These new regulations now apply in Wales, and the 2010 Regulations are no longer in force.  The purpose of these new regulations is to help prevent unsuitable registered childcare providers and those who wish to register as such, from caring for children.  The new regulations help to ensure the risk of harm to children is reduced and important safeguards are in place.

Welsh Government consulted upon a draft version of the regulations from 31 March 2022 to 23 June 2022 and then shared a summary of responses which largely welcomed the change proposals.

The Child Minding and Day Care (Disqualification) (Wales) Regulations 2022 were originally intended to replace the 2010 regulations but, because of technical drafting reasons, these have also been replaced by the Child Minding and Day Care (Disqualification) (No. 2) (Wales) Regulations 2022.

Care Inspectorate Wales (CIW) have informed all registered providers in Wales of these regulations coming into force and will publish updated guidance to support the Child Minding and Day Care (Disqualification) (No. 2) (Wales) Regulations 2022 to ensure that registered childcare providers or those who intend to provide childcare are clear about their legal obligations.
